Preliminary analysis of domestic vertical structure LED related patents

Vertical structure LED can effectively improve the driving current crowding and poor heat dissipation performance of LED chips in the formal structure. It can drive through a large current under the premise of ensuring luminous efficiency, achieving efficiency improvement and cost reduction. The high cost performance helps accelerate the process of LEDs entering the general lighting on a large scale. More experts have asserted that vertical structure GaN-based LEDs are the market direction and an inevitable trend in the development of semiconductor lighting, and will gradually become mainstream products.

In recent years, Cree, Osram, Philips Lumileds, SemiLEDs and other LED manufacturers have successively launched mass-produced GaN-based vertical structure LED products, while Nichia, SAMSUNG and other Japanese and Korean manufacturers, Jingyuan, Yiguang and other Taiwanese manufacturers and Sanan, Blu-ray China's mainland manufacturers (hereinafter referred to as domestic manufacturers) are also actively developing vertical structure LED chip technology. At the same time, in order to compete for the potential market of vertical structure LEDs, foreign manufacturers have begun to compete fiercely. For example, in April 2011, Cree accused SemiLEDS of producing and selling metal substrate vertical current-excited LEDs. Infringed on the six patents it held, and finally forced SemiLEDs to agree to stop importing and selling the products involved in the United States from October 1, 2012, and to give Cree compensation.

The author believes that although there have been no domestic manufacturers involved in patent litigation concerning vertical structure LEDs so far, the domestic LED industry should obtain more warnings from previous experiences and the aforementioned cases. On the one hand, we should continue to pay close attention to the patent risks faced overseas, and on the other hand, we need to guard against the corresponding patent infringement problems in mainland China.

In this article, I would like to make a preliminary analysis and discussion on the domestic vertical structure LED patents, as follows:

Since 1995, as of June 2012, a total of 166 patent applications related to vertical structure LED technology have been retrieved from the patent database published by the State Intellectual Property Office of China (see Figure 1), including 145 invention patent applications and 21 patent applications. The utility model patents, and the number of patent applications in each year continued to grow. (See Figure 2, although the number of patent applications declined in 2011, this may be due to the fact that some patent applications have not been announced.)
